Ohio’s definitions of assault and how they affect you
The following charges can be brought against you in an assault accusation:
- Negligent Assault: The lowest level of assault charge and a third-degree misdemeanor, negligent assault is causing harm to someone by means of a deadly weapon or dangerous ordnance used in a manner that disregards the safety of others.
- Simple Assault: This first-degree misdemeanor charge asserts that you knowingly or recklessly caused harm to someone, including an unborn child. However, there are many circumstances that can elevate simple assault to a felony charge. When lawyers or judges refer to assault, they usually mean simple assault.
- Felonious Assault: The most serious classification, assault becomes a second-degree felony if it causes serious physical harm or if an attempt to harm involved a deadly weapon.
- Aggravated Assault: A felony assault is a fourth-degree felony if the defendant committed the offense while in a fit of rage or under the influence of sudden, powerful emotion brought on by serious provocation.
